The following Terms And Conditions Serve as binding conditions to all online auctions hosted by Action 2 Auction.
Action 2 Auction may from time to time make changes to or alter these Terms and Conditions to accomodate buyers and sellers alike. These changes will be posted on our website with a link to our Terms and Conditions.
After such changes have been made and posted teh registeres party will be deemed to have accepted and agreed to the new Terms and Conditions. Should you not agree to these Terms and Conditions you should not make any subsequent use of our online bidding platform.
- Bidders must register to participate in the auction.
- All bids will attract a 10% buyers commision fee above the bid price.
- No VAT will be charged unless otherwise specified.
- All goods are sold without Guarentee or Warrenty.
- We reserve the right to control, regulate and record the auction. (The recoding shall be Prima Facie Evidence of the Auction Proceedings)
- We willnot be liable for any errors of descriptions of the items on the auction.
- No ringing will be permitted and suspected bidders will be suspended or terminated.
- Every bid (the act of clicking on the bidding button) shall constitue an offer to purchase for the amount bid.
- No bid can be withdrawn.
- A sale by auction is complete by the fall of the hammer or any other customary manner.
- All goods are sold “Voetstoots” AS IS.
- Items sold as new or working can be tested upon collection within four working days after the conclusion of the auction. (Should it not be working the sale is void able – this is only applicable to items sold as New or Working)
- Once goods have been paid and signed off from the buyer and the seller. the buyer has accepted the goods and cannot be refunded for any reason whatsoever.
- All sales are done in the following manner.
- No reserve – No established minimum price.
- Reserve – Minimum price has to be attained. Vendor bidding is permitted up to but not exceeding the reserve price.
- S.T.C – Subject to confirmation. The seller has to agree or disagree on the highest bid within 2 days of the closing of the auction.
- The bidder with the highest bid accepted shall be the purchaser if no Reserve or S.T.C is applicable to the item.
- The auctioneer may accept or reject bids in his/her sole discretion without providing reasons.
- In the event of a dispute between bidders the auctioneer will have the discretion to put the lot up for auction again and his/her decision will be final and binding.
- The auctioneer may without penalty or prior notice withdraw any item on the auction at any time before or during the auction.
- The auctioneer will reserve the right to extend the bidding time should last minute bidding take place. (Sniper Protection).
- The auctioneer is entitled to correct any Bone a fide error during or after any sale or arising from any incorrect information to the items.
- In the event that an error is not capable of being corrected, the auction shall be deemed as not taking place and no party will have claims against the auctioneer or the seller arising from the cancellation of the auction.
- Risk on each item falls on the purchaser after the end of the auction when the lot closes even though the goods have not been collected or delivered.
- The purchaser will bear the risk of the items remaining on the permisis regarding shortages and damage.
- The purchaser will be held liable for the cost of repairs for any damages caused to teh premises when collecting purchases or otherwise.
- The payment of good purchased on the auction must be paid within 48 hours after the completion of the auction by means of instant electronic payment, cash on the premises, cash deposit (2% extra charge) or by card on the premises (3% extra charge).
- Goods must be collected within 10 eworking days after the completion of the auction. A R 50.00 per day storage cost will come into play for late collections.
- Goods not collected within 21 days will be resold to cover the storage costs.
Please note that online bidding is dependant on the bidders internet connection and Action 2 Auction (action to auction) cannot be held liable for bids not received due to poor internet connection or any other circumstances.
Ownership of goods will only pass to on to teh purchaser once full payment has been received and the goods have been collected.
Any person who registers for the auction regards these Terms and Conditions binding and agrees to all the Terms and Conditions.
